1. Agreement to Terms

Welcome to Scholarship Whisperer (scholarshipwhisperer.com) (the Site). These Terms of Service (Terms) are a legal agreement between you (you or user) and Tara Piantanida-Kelly, doing business as Scholarship Whisperer (Scholarship Whisperer, we, us, or our), a sole proprietorship.

By accessing or using the Site, purchasing any product or service, or booking a call through the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products or services.

We may update these Terms from time to time. If we make changes, we will update the Effective Date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

2. Who We Are and What We Offer

Scholarship Whisperer provides educational content and consulting related to paying for college, including:

1:1 video advising calls
Ebooks
Mini-courses
Bundled packages combining the above

These are collectively referred to as the Services. Details, pricing, and availability of specific Services are described on the Site and may change at any time.

3. Eligibility

You must be at least 18 years old to purchase Services or enter into these Terms. The Site is intended for parents, guardians, and adult students researching how to pay for college — not for use by minors independently. If you are under 18, you may only use the Site under the supervision of a parent or guardian who agrees to these Terms on your behalf.

4. Intellectual Property

All content on the Site — including text, graphics, logos, course materials, ebooks, video content, designs, and the overall look and feel of the Site — is the property of Scholarship Whisperer or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, publicly display, create derivative works from, sell, or otherwise exploit any content from the Site or from any product you purchase (including ebooks, course materials, or call recordings, if provided) without our prior written permission. This applies whether or not the content is marked with a copyright notice.

When you purchase a Service, we grant you a limited, non-exclusive, non-transferable license to use that content for your own personal, non-commercial purposes. You may not share, resell, or redistribute purchased materials.

5. Acceptable Use

When using the Site, you agree that you will not:

Use the Site for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to the Site, our systems, or other users' accounts
Introduce viruses, malware, or other harmful code
Scrape, crawl, or use automated means to access or copy content from the Site without permission
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Harass, abuse, or harm another person through your use of the Site
Interfere with or disrupt the operation of the Site or servers/networks connected to it

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending access, or reporting conduct to law enforcement.

6. Purchases, Payment, and Refunds

Payment. When you purchase a Service, you agree to provide accurate and complete payment information and authorize us (or our payment processor) to charge the applicable fees.

Refunds and cancellations. We offer a 30-day refund window from the date of purchase for ebooks, mini-courses, and 1:1 call packages. To request a refund, contact us at tarapk@scholarshipwhisperer.com within 30 days of your purchase date.

For 1:1 calls that have already taken place, the refund window applies to the purchase, not a re-do of the call itself; we handle these requests case-by-case and in good faith.
If you need to reschedule a booked 1:1 call, please contact us as soon as possible; we ask for at least 24 hours' notice where possible.
Refunds are issued to the original payment method and may take several business days to appear depending on your bank or payment provider.

We reserve the right to decline a refund request that we reasonably believe is fraudulent or abusive, or that falls outside this window.

7. Educational Purpose Only — No Guaranteed Outcomes

Scholarship Whisperer's content, ebooks, courses, and 1:1 calls are provided for educational and informational purposes only. While our guidance is grounded in over 33 years of firsthand experience working inside college financial aid offices, nothing on the Site or provided through our Services constitutes:

A guarantee of any specific financial aid award, scholarship amount, or admissions outcome
Individualized legal, tax, or financial advice
A substitute for consultation with a licensed attorney, CPA, or financial advisor for your specific circumstances

Financial aid outcomes depend on many factors outside our control, including each institution's policies, your family's individual financial circumstances, and information you provide to us or to schools. We do not guarantee that following our guidance will result in any particular amount of aid, scholarship, or savings.

8. Account Termination

If your use of the Site involves any account, login, or ongoing access (now or in the future), we reserve the right to suspend or terminate that access at our discretion, including for violation of these Terms, without prior notice, though we will act in good faith and communicate with you where practical.

We also reserve the right to refuse service, cancel orders, or restrict access to the Site to anyone, at any time, for any lawful reason.

9. Third-Party Links and Content

The Site may contain links to third-party websites, tools, or resources (for example, financial aid calculators, government sites like studentaid.gov, or other referenced resources) that are not owned or controlled by Scholarship Whisperer. We are not responsible for the content, accuracy, or practices of any third-party site. Your use of third-party sites is at your own risk and subject to their own terms.

10. Disclaimer of Warranties

The Site and all Services are provided on an as is and as available basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is complete, accurate, or up to date. Financial aid rules, forms (like the FAFSA and CSS Profile), and institutional policies change over time; while we make every effort to keep our content current, you should always confirm requirements and deadlines with the relevant institution or agency.

11. Limitation of Liability

To the fullest extent permitted by law, Scholarship Whisperer and Tara Piantanida-Kelly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, savings, financial aid, or scholarship opportunities, arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us for the Service giving rise to the claim in the twelve (12) months before the claim arose.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Scholarship Whisperer and Tara Piantanida-Kelly from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site or Services, or your violation of any law or third-party right.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law principles.

Before filing a formal claim, we ask that you first contact us at tarapk@scholarshipwhisperer.com so we can try to resolve the issue directly — most concerns can be worked out this way. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the state and federal courts located in Oregon, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may revise these Terms at any time by updating this page. Material changes will be reflected by an updated Effective Date. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any order-specific terms presented at checkout, constitute the entire agreement between you and Scholarship Whisperer regarding your use of the Site and Services, and supersede any prior agreements.
